By accessing and using WandInk ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

WandInk is a Chrome extension that provides AI-powered writing assistance, including but not limited to grammar checking, text rewriting, translation, content generation, and page chat functionality. The Service works on various websites and platforms where text input is available.

3. User Accounts

Some features of WandInk may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Free and Paid Plans

WandInk offers both free and paid subscription plans. Free plan features include unlimited local AI writing with Gemini Nano and limited cloud AI generations. Paid plans (Pro and BYOK) provide additional features and capabilities as described on our pricing page. Subscription fees are non-refundable except as required by law.

5. Acceptable Use

You agree not to use the Service:

• For any illegal purpose or in violation of any laws
• To generate harmful, abusive, or offensive content
• To infringe upon intellectual property rights
• To attempt to gain unauthorized access to the Service
• To interfere with or disrupt the Service or servers
• To use automated systems to access the Service without permission

6. Intellectual Property

The Service, including its original content, features, and functionality, is owned by WandInk and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service.

7. User Content

You retain ownership of any content you create or input using WandInk. By using the Service, you grant WandInk a license to use, process, and store your content solely for the purpose of providing the Service. For features using on-device processing (like Gemini Nano), your content never leaves your device.

8. API Keys (BYOK Plan)

If you use the BYOK (Bring Your Own Key) plan, you are responsible for managing your own API keys and any associated costs. WandInk is not responsible for any charges incurred through your API key usage. You must keep your API keys secure and not share them with others.

9. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding the collection and use of your information.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. WandInk does not guarantee that the Service will be uninterrupted, error-free, or completely secure. AI-generated content may contain inaccuracies and should be reviewed before use.

11. Limitation of Liability

To the maximum extent permitted by law, WandInk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
